  • 1. LIMITED WARRANTY – Any part of the equipment sold to the Customer under this Agreement which proves to be defective in material or workmanship within thirty (30) days of sale will be repaired or replaced at ProTec’s option with a new or functionally operative part. This warranty is extended only to the original consumer of the system and may be enforced only by such person. To obtain service under this warranty, call ProTec at 1-800-942-3141. Service pursuant to the warranty will be furnished only during ProTec’s normal working hours, 8:00 a.m. to 5:00 p.m. Monday through Friday, excluding holidays. Services rendered outside the normal working hours of ProTec are not within the scope of the warranty, and any services requested to be performed at such times shall be charged at ProTec’s then applicable rate for labor and materials.

    Conditions not covered by warranty: A. Damage resulting from accidents, acts of God, alterations, misuse, tampering or abuse. B. Failure of the Customer to properly close or secure a door, window, or other point protected by a burglar alarm device. C. Failure of Customer to properly follow operating instructions provided by the manufacturer of the equipment at time of installation or at a later date. D. Trouble due to interruption of commercial power. E. Trouble due to interruption of cellular and or internet service. F. The expense of ordinary maintenance and repair of said system due to normal wear and tear. G. The expense of extraordinary maintenance and repair due to alterations in the Customer’s premises; alterations of the equipment made at the request of the Customer; or made necessary by changes in the Customer’s premises; damage to the premises that damage the equipment or any cause beyond the control of ProTec.

    The above limited warranty is in lieu of all other express warranties. ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE SHALL COINCIDE IN DURATION WITH THE THIRTY (30)-DAY LIMITED WARRANTY. The exclusive remedy of the Customer shall be repair or replacement; Under no circumstances shall ProTec be liable to the Customer or any other person for incidental or consequential damages of any nature including, without limitation, damages for personal injury or damages to property, and however occasioned whether alleged as resulting from breach of warranty by ProTec, the negligence of ProTec, or otherwise. ProTec’s liability will in no event exceed the purchase price of the equipment. No agent, employee or representative of ProTec nor any other person is authorized to modify this warranty in any respect except in writing signed by the general manager of ProTec.

    2. INSTALLATION BY CUSTOMER – Customer acknowledges that in purchasing the equipment, the Customer will be performing all installations and maintenance of the equipment and ProTec will be providing no installation or maintenance services following the sale of the equipment to Customer; therefore, Customer shall be solely responsible for the installation of the equipment. Any damages to the equipment as a result of the manner in which the equipment is installed shall be the sole responsibility of the Customer. Customer further acknowledges and agrees that ProTec shall not be responsible or liable for any other damages – whether direct, indirect, incidental, consequential or any other type – caused by or in any way related to the manner in which the equipment is installed or maintained by Customer or any third party. Statements relating to the equipment or its installation, made prior to execution of this sale, are not warranties regarding the proper installation of the equipment. It is understood that such statements were not intended to, and did not, form a part of the sales agreement.

    3. REPAIRS AND PARTS REPLACEMENT – After the Limited Warranty Period or as to conditions excluded from Limited Warranty, ProTec will, if requested, provide Customers with parts replacement for the equipment at ProTec’s then prevailing process and terms (including paragraph 6, Limit of Liability).

    4. CUSTOMER MONITORING AND TESTING – The Customer shall be solely responsible for monitoring any signals and videos generated by the equipment. The Customer shall be responsible for procuring and performing the testing of the connections of the equipment with a monitoring station chosen and arranged by ProTec. Customer acknowledges it shall be solely responsible for initiating and following through with any calls to any and all call-centers for sending test signals to verify the equipment’s connection with any call center. The Customer is solely responsible for providing to Customer’s monitoring center the telephone number(s) and other contact information of all applicable local law enforcement authorities, fire department(s), emergency medical system or other emergency assistance providers.

    5. CANCELLATION –It is understood and agreed that this Limited Warranty may be terminated by ProTec in the event the Customer fails to follow any recommendations ProTec may make for the repair or replacement of defective parts of the equipment covered under the Limited Warranty or in the event the Customer’s failure to follow the operating instructions provided at the time the Customer’s equipment was purchased results in an undue number of false alarms or if the premises in which the Customer installed the equipment are so modified or altered after installation as to render continuation of service impractical, or in the event of default of payment of any monies due under this Agreement.

    GENERAL TERMS AND CONDITIONS

    6. LIMIT OF LIABILITY - It is understood that ProTec is not an insurer. Insurance, if any, shall be obtained by the Customer. The amounts paid to ProTec for the purchase of the equipment hereunder are based upon the value of the equipment when sold and are unrelated to the value of the Customer’s property or property of others located in Customer’s premises. PROTEC MAKES NO GUARANTEE OR WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS THAT THE EQUIPMENT SUPPLIED WILL AVERT OR PREVENT OCCURRENCES, OR THE CONSEQUENCES THEREFROM, WHICH THE EQUIPMENT IS DESIGNED TO DETECT. It is impractical and difficult to fix the actual damages, if any, which may proximately result from failure on the part of the equipment sold by ProTec to the Customer to perform any of its obligations hereunder. The Customer agrees that ProTec shall be exempt from liability for loss, damages or injury due directly or indirectly to occurrences, therefrom, which the equipment is designed to detect or avert. If ProTec should be found liable for loss, damage or injury due to failure of the equipment in any respect, its liability shall be limited to the Customer’s purchase price of the equipment from ProTec, as the exclusive remedy, and the provisions of this paragraph shall apply if loss, damage or injury, irrespective of the cause or origin, results directly or indirectly to person or property from performance or nonperformance of obligations imposed by this contract or from negligence, active or otherwise, of ProTec, its agents or employees. In the event any person not party to this Agreement shall make any claim or file any lawsuit against ProTec for failure of the equipment in any respect, Customer agrees to indemnify and hold ProTec harmless from any and all such claims and lawsuits including the payment of all damages, expenses, costs and attorney’s fees.

    7. ASSIGNMENT – This Agreement is not assignable by the Customer except upon prior written consent of ProTec. ProTec shall have the right to assign this Agreement or to subcontract any of its obligations under this Agreement without notice to Customer.
